Welcome to Topline Pro and thanks for reviewing our privacy policy. Dwelling Management, Inc., and its affiliates, parents, and subsidiaries ("Topline Pro" or "we", "us", or the "Company") take your privacy seriously. This Privacy Policy explains how we collect, use, share, and protect your Personal Information. If you do not want us to handle your Personal Information in this manner, please do not use the Topline Pro. Personal Information is information that relates to you as an individually identifiable person, such as your name, e-mail address, and mobile number.

This Privacy Policy explains:

  • How to contact us with questions about this Privacy Policy

This Privacy Policy applies to (a) information that we collect on the Website and (b) Topline Pro mobile application. 

I. INFORMATION WE COLLECT.

a) Personal Information You Give Us

We collect information that you voluntarily share with us through the Topline Pro Website and Application.

If you are using the Website or Application, you may give us:

  • Contact information and identifiers, such as your name, physical address, telephone number, and email address
  • Information about your business, such as the number of employees, the types of work that you do, zip code or postal code where your business is located and information about current software that you use
  • Billing information, such as credit or debit card number, expiration date & security code and/or other digital payment accounts 
  • Photos and Videos

Although users can submit credit card or other payment card information to pay for a service through the Topline Pro Website, Topline Pro does not receive this information itself. Payment card information is transmitted directly to a third-party payment card processor, Stripe, through an Internet connection secured by industry-standard Transport Layer Security (TLS) encryption technology. Stripe then communicates to Topline Pro whether your payment has cleared, but does not provide payment card information to Topline Pro.

b) Surveys and as part of your use of Topline Pro services

You may, at your choice, complete surveys on or distributed by Topline Pro about, for example, your level of satisfaction with the Topline Pro application, your engagement with the Topline Pro application, and your awareness of Topline Pro features. In some cases, we may link the information you provide in the survey with Personal Information in your Topline Pro account, such as your name or email address. When linked to Personal Information, your survey information becomes Personal Information too.

You may have the ability to post information through Topline Pro's services or website, such as comments, that may be viewed by others within your organization, or by third parties, if you so choose. Please be advised that any personal information that you voluntarily post to any public forum or to any area where other users or third parties may legally access it, will NOT be considered confidential in any way, and Topline Pro will not have any obligation to protect it in a secured system or obtain your consent to its disclosure, as you will have made the decision to publicly post it. However, at your request, Topline Pro will be happy to change it, remove it, or restrict access to it (subject to technical feasibility) in order to protect the integrity of the personal information.

When you contact any Topline Pro employee by telephone, e-mail, in person, or through our website, you will be asked to provide consent to the collection of personal information if your personal information will help us deliver the information, products, or services you require.

From time to time, Topline Pro may invite you to provide us with information for specific purposes. We may ask for this information through feedback features on our website or software; we may send out email inviting feedback or offering products and services; or we may ask you for information concerning support of our products or services. Your response to these communications may require you to submit personal information and opinions.

c) Information We Collect Through Technology

We collect information through technology to enhance our ability to serve you. When you access and use the Topline Pro website or application, our third-party service providers collect information about you or how you interact with the Topline Pro website and application. We describe below a few of the methods we use to collect information through technology.

Topline Pro's application and services contain features that automatically collect information from users, such as usage statistics, and other tracking information, such as call and message history and statistics (eg. duration, location and time), phone number, information about the mobile device used with the services, login attempts, and application specific logs and errors. Although this information may not identify you personally, it nevertheless provides certain information about you, and we therefore handle it as confidential information, with security measures to protect it, such as encryption and user authentication protocols.

When you visit the Topline Pro website, we collect your Internet Protocol (IP) address. An IP address is often associated with the portal you used to enter the Internet, like your Internet service provider (ISP), company, association, or university. While an IP address may reveal your ISP or geographic area, we cannot determine your identity solely based upon your IP address. However, we may link the last IP address you used to access the Topline Pro website and application to Personal Information you provide us. Where, according to local law, IP addresses and the like are considered Personal Information, we treat them as such.

We may also collect a unique identifier for your computer, mobile device, or other device used to access the Topline Pro website and Application ("Device Identifier"). A Device Identifier is a number that is automatically assigned to the device you used to access to Topline Pro. We may link the Device Identifier to other information about your visit, such as what pages you viewed, and to Personal Information you provide us, such as your name. In addition to these methods, we may also collect information about how you interact with Topline Pro through advertising partners and data enrichment tools.

When you provide consent through Google OAuth, we collect information pertaining to the scopes that you consent to provide. Our use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements. We will use your data to provide you with the services you requested, such as calendar event scheduling. We will not sell your data to third parties, but we may share it with our partners who help us provide our services.

We share some collected information with third-party tools such as AI models. That information includes, but is not limited to, company name, industry, services, photos, and reviews.

d) Do We Use Cookies?

Yes.

e) Web Beacons

We may include small graphic images or other web programming code, called web beacons (also known as "pixel tags", "web bugs" or "clear GIFs"), in our web and mobile pages and messages. The web beacons are minute graphics with a unique identifier. They are used to track the online movements of Web users. In contrast to cookies, which are stored in a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. Web beacons help us better manage content on Topline Pro by informing us what content is effective, monitoring how users navigate Topline Pro, counting users of Topline Pro, and counting how many e-mails sent by us were actually opened.

f) Information You Provide About A Third Party

If you choose to use our referral service to tell a friend about the Topline Pro, we may collect your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit Topline Pro. We store this information only to send this one-time email and to track the success of our referral program. We do not use this information for any other marketing purpose unless we obtain consent from that person or we explicitly say otherwise. Please be aware that when you refer a friend, your e-mail address may be included in the message sent to your friend.

g) Information Third Parties Provide About You

i) Conversion Tracking: We may supplement the information we collect about you through Topline Pro with records received from third parties in order to enhance our ability to serve you, to tailor our content to you, and to offer you information that we believe may be of interest to you. For example, websites on which we have placed advertisements, such as Google, may tell us which ads about Topline Pro you clicked. This is often called "conversion tracking."

ii) Recording Phone Calls: Selected third-parties, including those who may assist in providing customer service support, may monitor and/or record the contents of phone calls made through or in relation to the Topline Pro, after notice to you and with your consent.

We will apply this Privacy Policy to any Personal Information received from third parties, unless we have disclosed otherwise.

f) Information You Provide to a Third Party

Topline Pro includes links from Topline Pro to sites or applications operated by third parties ("Third-Party Sites") and plug-ins (such as Twitter buttons) from Third-Party Sites.

Topline Pro does not control any Third-Party Sites, and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by that site's privacy policy.

We recommend that you read the Third-Party Site's privacy policy if you choose to enter any Third-Party Site or click on a plug-in.

II. How we may share that information and for what purposes

Your personal information is protected

Topline Pro uses reasonable precautions to protect personal information and store it securely. Topline Pro uses and discloses your personal information if it helps us facilitate your needs, provide you with the services, improve our products and service, or manage our internal business operations. 

We will only share your information to which you have consented. In a few circumstances Topline Pro may need to disclose your information if required to do so by law, or if we believe in good faith that such disclosure is necessary. The following are the ways and purposes for which we share your information:

a) Third Parties Providing Services on Our Behalf: Third party companies and individuals provide or facilitate certain aspects of the services offered through the Dwelling Platform on our behalf. We may provide these third-party service providers with access to your information, including your Personal Information, so that they can perform these services for us. We require these third-party service providers to provide safeguards for your Personal Information similar to the ones that we provide.

b) Banks and Credit Card Companies: We may disclose your Personal Information to banks and credit card companies in the process of investigating payment fraud and/or responding to disputed charges.

c) Sweepstakes, Contests and Promotions: We may offer sweepstakes, contests, and other promotions (any, a "Promotion") through Topline Pro that may require providing Personal Information to register. By participating in a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, allowing the sponsor of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. Please read the official rules carefully. If you choose to enter a Promotion, Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners' list.

f) Required Disclosures: We may be required to disclose Personal Information in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.

g) Legal Compliance and Protections: We may disclose account and other Personal Information when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of Topline Pro, our users, or others. This includes exchanging Personal Information with other companies and organizations for fraud prevention and credit risk reduction.

Topline Pro will always try to provide you with prior notice of such disclosures; however, such notice may not always be possible or reasonable given the circumstances. 

III. Your choices regarding the information we collect 

Under the California Consumer Privacy Act (CCPA) and other similar data privacy legal regimes, you are entitled to see any information we have about you that can be used to identify you personally (“Personal Information”) at any time. You are also entitled to request us to delete your Personal Information from our system in full. We are not able to delete your Personal Information that has been aggregated with other information relating to Registered Users, but in that form it cannot be used to identify your personally any longer. This section lays out how to exercise your rights under the CCPA.

You may send us an e‑mail at support@toplinepro.​com to request access to, correct or delete any Personal Information that you have provided to us. We may be required to delete your user account in order to delete your Personal Information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

In addition, you may cancel or modify the email communications you have chosen to receive from the Dwelling Platform by following the instructions contained in emails from us.

Data Security:

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your PII transmitted through our Services. Any transmission of PII is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
